Who this covers
[Company legal name] runs CountMeIn. These terms cover the site, accounts, commits, and payouts. If you use CountMeIn, you agree to these terms, the Privacy Policy, and the Refund & Cancellation Policy. Organizers also agree to the Organizer terms.
CountMeIn is not for children under 13.
What CountMeIn is
CountMeIn is a platform for group events. An organizer posts an event and sets a minimum. People commit. A saved card is charged only if that minimum is reached before the deadline. We are not the event provider, and we do not host, guide, or insure the event.
Accounts
You sign in with an email link. You are responsible for the email address you use and for what you do while signed in. We can refuse, suspend, or close an account for fraud, non-delivery, abuse, or a breach of these terms.
Pricing and charging
The organizer receives the full ticket price. The person who commits pays the ticket price plus a platform fee (currently 5%, shown at checkout) plus payment processing. Both amounts are shown at checkout. CountMeIn keeps the platform fee. Stripe keeps the processing amount. The rate is the organizer's tier rate shown here, and it stays the rate locked when you commit. A ticket can include a cost buffer. The price shown includes that buffer, and unused buffer is refunded as a lower ticket price.
At commit, a card is saved. It is not charged. If the minimum is reached before the deadline, every saved card is charged immediately. If the deadline passes first, nobody is charged. Before that minimum, the organizer can raise the price. You have to confirm the new price within the time shown or you are dropped and not charged. The price cannot go up after the minimum is reached.
After the minimum is reached, commits stay open until the deadline or 14 days after the minimum is reached, whichever is sooner. A free event does not charge the people who commit.
Each account can publish 3 free events at no charge. After that, each additional free event costs $5. Paid events do not use that allowance. The amounts in effect are the ones shown when you publish or check out.
Voting
A vote on a location, venue, or other option is non-binding. It does not reserve a place or lock a price. The winning option becomes a commitment only when it is opened for commits.
Refunds
After the minimum is reached and a card is charged, there is no refund unless the event is cancelled, the organizer lowers the price, or a dropout is replaced under the Refund & Cancellation Policy. A price drop refunds the ticket difference only. The platform fee is not refunded. If nobody is charged, there is nothing to refund. Unused cost buffer is released the same way.
Organizers
The organizer is responsible for delivering the event, and for the accuracy of the listing, including the date, place, price, and what is included. The organizer is also responsible for taxes, permits, and any other legal duty that applies to the event.
Paid events need a US Stripe Express account before they can be published. Payouts are sent through Stripe Connect after commits close. Payouts go out when commits close. The current hold is 0 days. If a hold is set, the payout waits that many days after the event date and never goes out before commits close. The current reserve is 0%. If a reserve is set, that share of the ticket total is held and released after the event date. The platform fee is not part of the payout.
We may hold or reverse a payout, and we may suspend an account, if we believe there is fraud or the event is not delivered. The Organizer terms say the same rules in one place for people creating events and setting up payouts.
Problems, chargebacks, and liability
If something is wrong with the event, contact the organizer first. If you still need us, write to [contact email].
Chargebacks and card disputes are handled under these terms. We may debit, hold, or reverse a payout to cover a chargeback, a refund, or a reversal, and we may ask the organizer for information about the event.
To the extent the law allows, [Company legal name] is not liable for an organizer's failure to deliver an event, for a change or cancellation the organizer makes, or for indirect or consequential losses. If we are liable, that liability is limited to the platform fees we actually kept on the event. Some places do not allow these limits. Those laws still apply. Nothing here limits liability for fraud or for anything else that cannot legally be limited.
Changes
We can update these draft terms. The date at the top of the page changes when we do. Continuing to use CountMeIn after an update means you accept the updated draft. A fee or window already shown on an open event stays the one people saw at checkout or when that event opened for commits.
